We make the introduction. The treatment is theirs.

These terms set out what you can expect from Myotherapy, what we expect back, and where the line sits between a directory and the practitioners listed on it. Read them once — they are shorter than they look.

Four things worth knowing first

A summary, not the agreement. These cards are a plain-English overview only. The numbered clauses in the full Terms & Conditions govern use of the platform. Nothing in the summary or full terms excludes rights or protections that cannot lawfully be excluded under Australian law.

  1. 01

We connect, we don't provide treatment

Myotherapy is an independent directory that helps patients find practitioners and clinics. Treatment is provided by the practitioner or clinic you choose. We do not provide clinical care, diagnose conditions, prescribe treatment or give individual medical advice.

  2. 02

Practitioners are responsible for their profiles

Practitioners and clinics are responsible for ensuring their qualifications, services, fees, availability, rebate information and other profile content are accurate and current. Where we verify credentials, that verification is limited to the information and sources specified by us and does not constitute an endorsement or guarantee of clinical quality.

  3. 03

Practitioner listings are paid. Searching is free.

Patients can search the directory without paying Myotherapy. Practitioners and clinics pay to list on the platform. Payment provides access to directory listing features and visibility, but does not purchase a higher clinical rating, endorsement or recommendation.

  4. 04

    Your Australian consumer rights remain

Nothing in these terms excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law. If a provision is inconsistent with a non-excludable legal right, it applies only to the maximum extent permitted by law.

Two sides, two sets of duties

Most of these terms bind everyone. These are the ones that only bind one side of the directory, gathered so you can read your half without wading through the other.

If you are looking for treatment

Searching, comparing and enquiring are free and always will be. In return we ask you to use the directory honestly.

  • Give accurate details in an enquiry, so the practitioner can answer it properly.
  • Treat listing information as a starting point, not a diagnosis or a clinical recommendation.
  • Raise a concern about treatment with the practitioner and their association first — they, not we, are accountable for care.
  • Leave reviews only for treatment you actually received, and keep them free of anything defamatory.
  • Do not scrape, resell or bulk-extract practitioner details from the directory.

If you are listing a practice

A listing is a public representation that people will act on. The duties below are the price of that reach.

  • Hold the qualification your listing claims, and keep your professional association membership current.
  • Maintain professional indemnity and public liability cover, and give us a certificate of currency on request.
  • Keep every credential, screening check and first aid certificate up to date for as long as the listing is live.
  • Describe your modalities and rates accurately, and never imply a registration or endorsement you do not hold.
  • Answer enquiries in reasonable time, or turn your listing off while you are not taking patients.
  • Tell us within seven days if a regulator, association or insurer restricts your practice.

The agreement itself

Thirteen chapters, each one self-contained. Jump straight to the one you came for.

  1. 01

These terms and who they bind

By using the Myotherapy directory — searching it, sending an enquiry through it, or listing a practice on it — you agree to these terms. If you are agreeing on behalf of a clinic or company, you confirm you are authorised to bind it.

If you do not accept these terms, do not use the directory. We will not hold that against you.

  2. 02

What Myotherapy is, and is not

We publish a searchable directory of myotherapists, remedial massage therapists and the clinics they work from, and we pass enquiries to the practitioner you address them to.

We are not a healthcare provider, a clinic, an employer of practitioners, an insurer, or a booking agent acting for either side. We do not supervise treatment, hold clinical records, or verify that a particular treatment is right for you.

  3. 03

    Your account

Keep your password to yourself and tell us promptly if you think someone else has it. Anything done through your account is treated as done by you until you tell us otherwise.

You must be at least 16 to hold an account. Where treatment is for a child, an adult makes the arrangement.

  4. 04

Verification, and our right to remove a listing

Practitioners and clinics can submit their qualification, association membership and insurance, along with any screening check their state requires, for review. A verified badge means those documents were sighted and current at the time of checking — nothing more, and it is not an endorsement or a guarantee of clinical quality or outcomes.

We may suspend or remove a listing at any time, with notice where practical, if a document lapses, a claim on a profile turns out to be wrong, a regulator restricts the practitioner, or we form a reasonable view that patients are at risk.

  5. 05

    Subscriptions, billing and cancellation

Listing plans are billed in advance on the cycle shown at checkout and renew automatically until cancelled. Prices include GST where it applies.

You can cancel at any time from the subscription screen. Cancelling stops the next renewal and leaves the listing live until the paid period runs out. We do not pro-rate part-months, but if we materially reduce what a plan includes mid-term, you may cancel and take a refund of the unused portion.

  6. 06

    Reviews and content you post

You keep ownership of what you write, and you grant us a licence to display it on the directory and in material that promotes the directory.

We remove content that is defamatory, discloses someone else's health information, impersonates a person, or is posted by anyone with a commercial interest in the outcome. We do not remove a review simply because a practitioner dislikes it.

  7. 07

    Intellectual property

The directory's design, code, copy and brand belong to Myotherapy. Practitioner photographs and profile copy belong to the practitioners who supplied them.

You may not copy the directory, extract its listings in bulk, or use our name or marks in a way that suggests we endorse you.

  8. 08

Availability and changes to the service

We work to keep the directory available, but we do not promise it will be uninterrupted. Maintenance, outages at our suppliers and events outside our control all happen.

We may add, change or retire features. Where a change materially reduces what a paid plan includes, we will tell subscribers before it takes effect.

  9. 09

Liability, and the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy the Australian Consumer Law gives you and which cannot lawfully be excluded.

Subject to that, we are not liable for the treatment a practitioner provides, the accuracy of what they publish, or any loss arising from an arrangement you make with them. Where we are liable and the law allows us to limit it, our liability is capped at the fees you paid us in the twelve months before the claim, or one hundred dollars if you paid us nothing.

  10. 10

    Indemnity

If you list a practice, you indemnify us against claims arising from your treatment of a patient, from a false or misleading statement on your listing, or from your breach of these terms. This clause survives the closing of your account.

  11. 11

    Suspension and termination

You may close your account at any time. We may suspend or close an account that breaches these terms, and we will tell you why unless a law stops us.

Closing an account removes the listing from the directory. What we keep afterwards, and for how long, is set out in the privacy policy.

  12. 12

    Governing law and disputes

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

Before either of us goes to court, we each agree to raise the issue in writing and give the other 21 days to resolve it. Nothing in this clause stops either of us from seeking urgent relief.

  13. 13

    Changes to these terms

We update the version and effective date at the top of this page whenever these terms change. Material changes are emailed to account holders before they take effect, and continuing to use the directory afterwards means you accept them.

Using the directory is how you accept this

There is no box to tick. Searching the directory, sending an enquiry through it or listing a practice on it is acceptance of everything above, from the effective date at the top of this page.

Something unclear?

Ask us before you agree rather than guess. We would far rather explain a clause than argue about it later.
